Some reports suggested that out-of-state same-sex couples would marry in California prior to the elections because California does not require the marriage to be valid in the couple's home state.
However, under a law that went into effect January 1, , same-sex couples who married in California but live out-of-state (and, thus, cannot meet California’s normal divorce residency requirement) can still get divorced in California if they live in a state where they cannot divorce.
